Welcome to OmicsChart PREON, an online analytical platform. These Terms and Conditions ("Agreement") are entered into by OmcisChart GmbH ("OmicsChart") and the entity executing this Agreement ("You").Before you proceed to use our services, please carefully read and understand the following terms and conditions, as they govern your access and use of OmicsChart PREON ("The platform"). By subscribing to our data product and uploading data, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use the platform.
1. Data Product Subscription
1.1 Subscription Duration: By subscribing to our data products, you will have access to the curated and aggregated data on the platform for a period of 30 days, starting from the date of your subscription.
1.2 Limited Liability: OmicsChart shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to the use or inability to use the platform or data product. We provide the platform and data "as is," without any warranties of any kind.
1.3 Access to Aggregated Data: Please note that as a subscriber, you will only have access to aggregated and anonymized data on the platform. You will not have the ability to access or download raw data from the platform.
1.4 Data Removal: OmicsChart reserves the right to remove any data and analytics product from our platform at our sole discretion. This may occur in cases of data violation, partnership termination, inappropriate content, or any other reason that contravenes our platform policies or terms of use. If we decide to remove any data, we will make reasonable efforts to notify affected users, but we shall not be held liable for any loss or inconvenience resulting from such removal.
2. Data Upload
2.1 Data Ownership: You retain all rights and ownership to the data uploaded to OmicsChart PREON. We do not claim any intellectual property rights over your data.
2.2 Data Usage: OmicsChart does not share or use the data uploaded by users to generate intellectual property or for any purpose other than providing the services you subscribed to.
2.3 Data Deletion: Upon the expiration of the subscription term or termination of your account, OmicsChart will delete all the data uploaded by you within a reasonable timeframe. Please ensure that you have a backup of your data before the subscription term ends.
2.4 Data Security: We employ industry-standard security measures to protect your data from unauthorized access or disclosure. However, we cannot guarantee complete security, and you understand and accept the risks associated with transmitting data over the internet.
3. Data Processing and User Responsibilities
3.1 Data Processing Consent: By using the platform and uploading data, you grant OmicsChart the right to process the data solely for the purpose of providing the analytical services you subscribed to. As the user, you confirm that you have obtained all necessary consents and permissions from the data subjects, where applicable, for the processing of their data on our platform.
3.2 Data Processor: OmicsChart shall act solely as a data processor, processing the data on your behalf and as per your instructions. We will not use the data to generate any intellectual property or claim any ownership rights over the processed data.
3.3 De-identification Responsibility: As the user, you are responsible for ensuring that any personal or sensitive information contained within the data uploaded to our platform is appropriately de-identified or anonymized to comply with data protection regulations and to safeguard individual privacy. We strongly advise you to review and verify the data for de-identification before uploading it to our platform.
4. General Terms
4.1 Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.2 Compliance: You agree to comply with all applicable laws and regulations while using the platform, including but not limited to data protection and privacy laws.
4.3 Modification of Terms: OmicsChart reserves the right to modify these terms and conditions at any time. Any changes will be effective upon posting on the platform or notifying you via email.
4.4 Termination: OmicsChart may suspend or terminate your access to the platform at any time for violation of these terms or any other reason deemed necessary.
4.5 Governing Law: These terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflicts of law principles.
4.6 Entire Agreement: These terms constitute the entire agreement between you and OmicsChart concerning the subject matter herein and supersede all prior and contemporaneous agreements.
